Update November 14 2007
Dear Friends of the Omaha
Catholic Worker,
All went well in Douglas County Court for Peg Gallagher and Fr. Jack Mc Caslin
and Myself, Jerry Ebner on Wednesday Nov 14th at 1:30 pm
We were arrested for speaking out against "Weapons in Space" at the
Quest Center for the Space Defence Conference sponsored by STRATCOM/OFFUTT AFB
last October 10th.
We were charged with " Refusal to Leave" while participating in a
dies- in, a simulation or portrayof what the devastation of the use of military
weapons in space and nuclear weapons would be like.
Wednesday Nov 14th was only a pre - Preliminary hearing. Peg Gallagher's case
was waived for a further date by her lawyer, so that she would be free to go
to visit family members in Baltimore for the Thanksgiving holidays.
Fr. Jack and I were given the opportunity to accept a plea bargain by the prosecutor.
His offer was to plead guilty and pay a $50 fine. We declined, plead not guilty
and was asked to step aside and the clerk would give us a court date to attend
another hearing.
As best I know on this day, is that Fr. Jack Mc Caslin, and Jerry Ebner will
appear at court on Dec 14th Friday at 9 am for another preliminary hearing.
This hearing is to hear all of the evidence against us and a reading of the
misdemeanor statute.
As far as I no now, it is likely that a trial date will be chosen then, and
likely to be after January 1. That is my guess. The case with Peg Gallagher
will likely be joined with ours for court efficiency and her request to be joined
with the others as well.
I will be talking further with the City prosecutor before this date to clarify
any of this information. It might be possible to just go to trial on the Dec
14th. We will see, and so stay tuned.
